Paying a Zurich Sublet Deposit Before You Arrive: A Safer Checklist

A two-month deposit can be within Swiss residential-rental limits. That fact alone does not make a pre-arrival transfer safe—the contract, sublet consent, account structure, and handover plan must all match.

A two-month deposit is not automatically a red flag—but it is not proof either

Moving to Zurich for studies often creates a difficult sequence: a signed address may be needed for registration, while a bank may ask for documents connected to your planned address. Add a whole-flat sublet, an online viewing, and a payment request before arrival, and it can feel as though the only choice is to transfer money blindly.

Swiss law gives a useful anchor. Under Article 257e of the Swiss Code of Obligations, a residential landlord that receives security in money or securities must deposit it with a bank in a savings or deposit account in the tenant’s name. For residential premises, security may not exceed three months’ rent. The bank may release the security only with both parties’ consent or an enforceable payment order or judgment; after the tenancy ends, the tenant may request release if the landlord has not legally asserted a claim within one year.

That means a two-month deposit is below the federal three-month ceiling. It does not mean that every request for that amount is legitimate, that it belongs in a current tenant’s personal account, or that a primary tenant’s own deposit under the main lease protects a subtenant.

The Federal Office for Housing’s English guide likewise says rent is generally paid one month in advance and describes a special rental-deposit account in the tenant’s name. A sublet has two linked relationships

In a direct rental, the owner or manager and tenant are usually the obvious parties. A sublet has an additional layer:

Under Article 262 of the Code of Obligations, a tenant may sublet with the landlord’s consent. The landlord can refuse only in defined circumstances, including when the main tenant will not disclose the sublet terms, the terms are abusive compared with the main lease, or the sublet creates material disadvantages. The main tenant remains responsible to the landlord for the subtenant’s permitted use.

For a practical payment decision, ask for evidence that the owner, agency, or main housing provider has approved this whole-flat sublet for the named occupants and dates. A portal listing or a video tour can be useful, but neither establishes that consent on its own.

Do not let the “permit and bank account” loop force an unexplained transfer

It is easy to assume that you must first become a Swiss resident, then open a normal Swiss bank account, then create a rental-deposit account, and only then sign the sublease. The federal rental rule does not set that sequence.

Article 257e says where the qualifying security is held; it does not say that an incoming tenant must personally open the account or must already hold a residence permit. Individual banks can set their own identity, address, permit, signature, and onboarding requirements. Do not rely on a forum claim that a permit or a Swiss current account is always required—or always unnecessary. Instead, follow this sequence:

  1. Ask the sublessor to identify the proposed bank and send the official account-opening or deposit-instruction document that names both incoming tenants.
  2. Contact that bank through the bank’s own public website or telephone number, not a number supplied only in a message.
  3. Ask what it requires from incoming EU students with a signed sublease and whether the sublessor, owner, or agency must take part in the setup.
  4. Ask whether the signed sublease and university admission/enrolment evidence can begin the process, and preserve the bank’s answer in writing.
  5. If the correct account cannot be opened before arrival, ask the actual contracting party for a written, reviewable alternative: a documented account-opening process, a later deposit date, or temporary accommodation while the arrangement is completed.

An operational banking delay is a reason to clarify the transaction—not a reason to convert a protected deposit into an unexplained payment to a private account.

The ETH/UZH portal can reduce risk, but it does not replace due diligence

The ETH/UZH Housing Office says it reviews advertisements before publication. It also gives a clear fraud warning: if you have not seen the room or flat and do not fully trust the potential landlord, do not transfer money. Read the Housing Office’s search-accommodation guidance.

This is especially important for a private student sublet. An institution-managed reservation may legitimately have its own official pre-arrival payment process, which should be verified through the institution’s independently accessed website. Avoid cash, gift-card, cryptocurrency, or an urgent account change that is inconsistent with the signed documents. A change in payee or bank details is not automatically fraud, but it should trigger a pause and independent re-verification.

A payment sequence that does not rely on trust alone

The safest sequence is not “never pay before arriving,” because some legitimate reservations and advance-rent arrangements require payment. It is pay only when the necessary evidence lines up.

  1. Sign the complete sublease. Both proposed subtenants and the sublessor should be identified. Do not use a partial page or a text-message summary as the final agreement.
  2. Confirm consent. Ask the main landlord/agency to confirm the sublet through independently found contact details.
  3. Verify the deposit account. The official account documentation should identify the incoming tenant or tenants and match the deposit clause in the sublease.
  4. Confirm the first month’s rent. Make sure the amount, date, recipient, and payment method match the contract. Advance rent can be a normal arrangement; it is not a waiver of the rest of the checks.
  5. Record the handover. Confirm the key date, key holder, contact if access fails, inventory, meter readings if relevant, and move-in condition report.

For a private sublet, do not assume that an existing deposit paid by the main tenant under their own main lease is automatically your security. The sublease should state what your deposit is, where it is held, and how it will be returned.

A concise email to send before paying

Subject: Confirmation of Zurich sublet, deposit account, and handover

Before we sign or transfer any money, please send the final sublease signed by both parties and written confirmation from the main landlord or property manager approving this whole-flat sublet for both of us from [date] to [date].

Please also confirm the bank and account-opening process for the deposit, including documentation showing that the rental-deposit account is in our names. Please send the exact rent and deposit payment instructions, the total amounts, and the key-handover plan.

We will keep the agreement, payment record, and inventory together for our move-in file.

This request asks for documents rather than making an accusation. If the response is incomplete, internally inconsistent, or pushes you to use a different payment route, pause before paying and obtain independent advice.

Use the signed sublease for the next official steps—but keep banking separate

For arrivals in the City of Zurich, the City lists a lease, accommodation certificate, or sublease among the documents used for registration from abroad.
