How to Rent in Ireland Without a Landlord Reference After Separation

A missing landlord reference is a gap in an application, not permission to invent a tenancy history. Replace the missing document with a short explanation and a bundle of verifiable evidence.

A person whose marriage had ended described trying to find a new home in Ireland. They could provide payslips and evidence that rent had been paid. They had never missed a rent payment. But they earned only a little above the minimum wage, could not offer several months of rent in advance, and did not have a previous landlord willing or available to provide the reference demanded by agents.

That situation can arise for many legitimate reasons. Someone may have lived in a jointly rented family home, contributed rent through a spouse, owned the former home, rented informally, lived abroad, or simply have an unresponsive former landlord. None of those histories fits neatly into a standard “previous landlord” field.

The pressure to compete can make a fabricated letter, false email account or friend posing as a landlord sound like a shortcut. It is not a sound application strategy. A reference check can expose the falsehood, destroy the applicant's credibility, or create problems after a tenancy begins.

Quick answer: Irish official guidance treats references as part of rental screening, but the sources reviewed for this article do not identify a single statutory landlord-reference document that every prospective tenant must produce. A landlord or agent may still choose to make a genuine reference a condition of an offer, subject to data-protection and equality law. If a landlord reference is unavailable, explain the reason in one or two factual sentences and ask whether the property will accept a substitute pack: redacted rent-payment evidence, an RTB registration record or tenancy agreement if available, proof of current income, and a genuine employer or character reference. Do not fabricate a landlord, document, email address or tenancy history.

First, Identify the Actual Reference Gap

“I do not have a landlord reference” can describe several different problems. The correct substitute depends on which one applies.

Do not convert one history into another. If a person was a licensee, housemate or contributing spouse, they should not claim to have been the sole tenant or invent a landlord relationship.

The RTB explains that a lease or tenancy generally involves exclusive use of a property or part of it in return for rent, while renting a room in an owner-occupied home is often a licence outside the RTB's remit. Is a Landlord Reference Legally Required in Ireland?

The RTB tenant checklist asks whether a new tenant has provided references. That shows references are a recognized part of the market process. It does not establish a universal government form or a guarantee that one particular type of reference must be accepted.

Ireland's Data Protection Commission describes a more staged process. Its guidance says information such as references, financial details and proof of identity generally should not be collected indiscriminately from numerous people at the earliest application stage. In most cases, fuller evidence is more appropriate when a landlord has selected a preferred tenant and made an offer conditional on references and ability to pay. The practical position is therefore:

  • a landlord or agent can assess suitability and may ask a preferred applicant for a genuine reference;
  • an applicant has no general right to force a private landlord to accept an employer letter as equivalent to a landlord reference;
  • a landlord cannot use screening in a way that breaches data-protection or applicable equality law;
  • an applicant can ask what risk the reference is meant to address and propose verifiable evidence that addresses the same risk.

The objective is not to argue that the agent's checklist is invalid. It is to make the truthful alternative easy to assess.

Build a “Reference Replacement Pack”

Send a compact pack, not an emotional autobiography. It should answer four questions: Who is applying? Can the rent be paid? Is there evidence of reliable housing payments? Who can verify the applicant's general reliability?

1. A two-sentence gap explanation

The explanation should be honest and restrained:

My previous home was a shared marital home, and following our separation I am unable to obtain an individual landlord reference. I can instead provide evidence of consistent rent payments, current employment and income, and a genuine professional character reference.

Change the facts to match the real history. There is normally no need to describe intimate relationship events, conflict, medical information or allegations against a former partner.

2. Objective rent-payment evidence

Possible documents include:

  • a rent book or signed receipts;
  • a tenancy agreement showing the applicant's name;
  • an RTB registration confirmation or RT number from a registered tenancy;
  • bank transfers or standing orders that clearly correspond to rent;
  • an agent's rent ledger or a short payment-history confirmation;
  • a previous landlord's acknowledgment that rent was received, even if they will not provide a broader recommendation.

If the payment account includes personal spending, do not send the complete transaction history by default. The DPC has previously indicated that detailed transaction narratives will generally not be necessary to demonstrate capacity to pay; running balances or appropriately limited information may be sufficient. Redact unrelated transactions, account identifiers not needed for verification, and third-party data while keeping the applicant's name, relevant dates, payment amount and recipient visible where necessary. If rent was paid by a spouse, do not label someone else's transfer as the applicant's direct payment. Show the relationship between the contribution and rent only if it can be documented accurately.

3. Proportionate evidence of current affordability

An affordability section might include:

  • a current employer letter confirming role, employment status and salary;
  • recent payslips with unnecessary identifiers redacted;
  • evidence of regular lawful income relevant to the application;
  • a simple monthly budget showing the proposed rent is planned for;
  • a genuine guarantor, if one is available and the parties understand the written obligations.

An applicant should not claim savings, salary or a guarantor they do not have. Nor should they feel compelled to offer many months of rent merely to compensate for a missing reference. For a private residential tenancy, the RTB says a landlord cannot request a security deposit greater than one month's rent or more than one month's rent in advance. That normally means no more than the equivalent of two months' rent to secure the tenancy. 4. A genuine professional or character reference

A manager, long-term employer, regulated professional, former agent, housing officer or other person who genuinely knows the applicant may be able to confirm limited facts such as reliability, duration of acquaintance and responsiveness.

That is not a disguised landlord reference. Label it accurately:

Professional character reference — not a previous landlord reference.

The referee should use their real name and contact channel, know that they may be contacted, and state only what they can truthfully verify. Some agents will accept this alongside payment evidence; others will not. Ask before sending unnecessary personal details.

Send Personal Data in Stages

A competitive market does not cancel privacy law. The DPC found in a 2023 case that a letting agent's initial request for identification, proof of address, employment and landlord references, two months of bank statements and a PPS number was excessive at that stage. Use a staged disclosure model:

Ask the agent:

  • why each document is required;
  • whether it is required now or only after selection;
  • how it will be stored and shared;
  • when unsuccessful-applicant data will be deleted;
  • how to request erasure when the application ends.

Do not assume a PPSN is automatically required at the application stage. The RTB's current registration guidance lists a tenant's PPSN and date of birth as optional, although highly recommended. Do not alter a document so that a material fact becomes misleading. Redaction protects irrelevant data; it must not manufacture a false financial picture.

Do Not Trade Away Tenancy Rights to Look “Safer”

One tempting suggestion is to promise that the landlord can remove the tenant at any time during the first six months if dissatisfied. That is not an appropriate substitute for a reference.

For private tenancies, the RTB says a landlord can end a tenancy without stating a reason during the first six months, but must still serve a valid written Notice of Termination and, from March 1, 2026, send it to the RTB on the same day. The standard notice period for a tenancy lasting less than six months is 90 days. A fixed-term tenancy is different: the landlord generally cannot end it before the agreed date unless the tenant breaches the agreement. After six months of continuous occupation without a valid termination notice, statutory security-of-tenure rules can apply. A tenancy agreement cannot simply remove legal tenant rights. RTB: Tenant rights and responsibilities

Do not offer an informal “evict me whenever you like” clause. If an agent proposes unusual termination language, obtain tailored advice before signing.

Separation and Equality Law: Know What the Protection Does—and Does Not—Mean

Ireland's Equal Status Acts prohibit discrimination in accommodation on protected grounds including gender, civil status, family status, disability, race and housing assistance. This distinction matters:

  • rejecting someone because of a protected civil status, family status or lawful housing assistance may raise an equality issue;
  • asking for evidence of ability to pay, or choosing another applicant because a genuine screening condition was not met, is not automatically unlawful discrimination;
  • a reference gap caused by separation does not by itself prove that a rejection occurred because of civil status;
  • advertisements, messages, different treatment of comparable applicants and the stated reason for rejection may be relevant evidence;
  • exemptions can apply, including certain owner-occupied room rentals that affect the provider's private or family life.

If the facts suggest discrimination, preserve the advertisement, application, messages, dates and stated reason. The WRC says an Equal Status complaint generally must be made within six months of the incident, after written notification to the respondent, subject to the applicable procedure and possible extensions. Obtain advice rather than assuming every unexplained rejection is a legal case.

Do Not Let Urgency Create a Rental-Scam Loss

Someone rebuilding after separation may be especially vulnerable to an offer that appears to bypass normal screening. “No reference needed—send the deposit now” is not necessarily help.

The Competition and Consumer Protection Commission warns about fake listings, pressure to pay before a viewing or lease, advertisers who cannot show the property, and attempts to collect money or identity data. Its guidance recommends viewing the property, checking the advertiser and address, obtaining a written lease or rent book, using a traceable payment method, getting a written receipt, and preserving communications. Before paying:

  1. View the actual property and confirm that the person has authority and access to let it.
  2. If a letting agent is involved, verify the provider and its Category C licence on the Property Services Regulatory Authority register.
  3. Check the RTB public register where the arrangement should be registered; remember that some owner-occupied licence arrangements are outside RTB registration.
  4. Read the written tenancy terms, including rent, deposit, occupants and start date.
  5. Confirm the payee and use a traceable method.
  6. Obtain a dated receipt for the exact amount and purpose.
  7. Keep the listing, messages, agreement, payment proof and contact details.

If money or financial information has already been sent to a suspected scammer, contact the bank or card provider immediately and report the matter to the local Garda station. A Short Application Note

Use this only after changing every bracketed field to the truth:

Subject: Rental application for [property address]

Hello [agent or landlord name],

I am applying to rent [property] from [date] for [number] occupant(s). I am in ongoing employment with [employer or sector] and can provide current payslips and an employer confirmation.

My previous home was [a jointly rented marital home / an owned family home / another accurate description]. Following a separation, I am unable to provide a conventional individual landlord reference. I do not want to misdescribe that history.

I can instead provide [rent-payment records / tenancy agreement or RTB confirmation / agent payment ledger], together with a genuine professional character reference from [relationship to referee]. Would those documents be acceptable for this property's screening process?

Please also let me know which documents are required at the current stage, why they are needed, and how unsuccessful-applicant information is deleted.

This note is deliberately brief. Reliability is shown by the attached evidence, not by disclosing every detail of the marriage.

Ask for a Narrower Factual Reference

A former landlord may be unwilling to “recommend” someone but willing to confirm objective facts. Try this request:

Hello [name],

I am applying for new accommodation and understand that you may not provide a general recommendation. Would you be willing to confirm only the following facts for my tenancy at [address]: the tenancy dates, the agreed rent, whether rent shown in your records was paid on time, and whether the property was returned without recorded rent arrears or damage deductions?

Please include only facts you can verify. You may send the confirmation to me or, with my authorization, directly to [agent].

Thank you,
[Name]

If the answer is no, preserve the request and use the alternative pack. Do not draft a letter in the landlord's name or ask someone else to impersonate them.

If the Housing Situation Is Urgent

The rental application is only one track. Separation can also raise questions about rights and responsibilities in the existing family home. The Legal Aid Board explains that a separation agreement or judicial separation can address the family home, finances, children and other property. Its family mediation service is confidential and available at no cost, although mediation requires both people to participate and is not appropriate in every safety situation. Do not assume that leaving, remaining in, transferring or surrendering an existing home has no legal consequence. Seek individualized advice before signing away tenancy or property rights.

Should I send complete bank statements to every agent?

Not by default. The DPC says personal data should be necessary, proportionate and collected at the appropriate stage. Can a landlord ask for several months of rent because I have no reference?

For a private residential tenancy, RTB guidance says the deposit cannot exceed one month's rent and the landlord cannot request more than one month's rent in advance. Can I agree to leave immediately during the first six months?
