Decision rule

Santa Monica STR status: the answer first

Santa Monica prohibits unhosted vacation rentals of 30 days or fewer. A lawful short stay must be a permitted home-share in the host’s primary residence, and the host must remain on site throughout the visitor’s stay. The permit and business license are applied for together.

The hosted-versus-unhosted distinction is the first legal gate, not a later operating preference. A manager, platform, or co-host cannot cure the absence of the eligible resident host, and one person may not host more than one Santa Monica home-share.

Home-sharing is one or more bedrooms rented for 30 consecutive days or less in the host’s primary residence while the host maintains a physical presence in the dwelling throughout the visitors’ stay.

  • Only hosted home-sharing is allowed

Unhosted vacation rentals remain unlawful; only an eligible resident with an issued home-sharing permit and business license may operate the hosted model.

Address and property eligibility in Santa Monica

Complete these gates before buying services, paying a non-refundable charge, or copying a prior owner’s setup.

Approvals and records that must agree

Santa Monica compliance is a stack of separate records. Keep the legal owner, address, rentable space, dates, and contacts consistent across all of them.

Joint city application
Apply for the home-sharing permit and business license together.
Residency and relationship evidence
Provide two primary-residence documents plus ownership or long-term tenancy support for every host.
Safety and insurance
Certify smoke/CO alarms and fire extinguisher; provide $500,000 coverage or use only the packet’s identified qualifying platforms.
Listing disclosure
Within 10 days after the business-license number is issued, provide advertisements to Code Enforcement and include required disclosures.
TOT workflow
Collect and remit Santa Monica TOT alone or in coordination with the hosting platform.

A workable Santa Monica compliance sequence

The filing is a residency case as much as a business application. The strongest packet proves that each host is eligible, the dwelling is the true primary residence, the rental stays hosted, and the city-approved occupancy, vehicle, listing, safety, insurance, and tax controls are ready.

  1. Prove the model is hosted

Document where the host sleeps, which bedrooms are offered, and how the host remains physically present throughout every visitor stay.

  2. Build each host’s residency file

Collect two approved primary-residence documents and the applicable deed, tax bill, lease, prior-12-month, and next-12-month evidence.

  3. Calculate the city-approved limits

Use square footage, bedrooms, host and resident count, and parking-zone status to determine the lowest occupancy and vehicle limits.

  4. Submit the joint permit and license packet

Include business, host, property, platform, insurance, safety, and certification forms and wait for the city’s invoice and approval.

  5. Launch only after issuance

Add every required disclosure, send listing copies within 10 days, configure TOT, and retain proof that the host remains on site.

Tax and marketplace handling for Santa Monica

A permit, tax account, platform collection, and filed return are different records. Reconcile them at booking level.

Santa Monica’s code imposes TOT on home-sharing, and the host certifies collection and remittance either directly or in coordination with a platform. Do not infer that a platform closes the city account: reconcile the listing, stays, amounts collected, exemptions, returns, and the party that remitted each booking.

  • Collection does not prove filing or land-use authority

Keep a dated record of who collected each tax, who filed each return, and which official account covers the exact Santa Monica property.

    Warning

Operating controls and enforcement exposure

Translate the approval into repeatable listing, guest, contact, physical-property, tax, and renewal controls.

False or omitted application information, unhosted operation, missing listing disclosures, excess occupancy, unpaid citations, or repeated final citations can support denial, suspension, or revocation. The administrative rules describe a 30-day suspension after two final citations and revocation exposure after three or more during the license term.

  • Santa Monica operating control 1

The eligible host must physically remain in the home-share throughout every visitor stay; exclusive transient possession is prohibited.

    Required
  • Santa Monica operating control 2

Do not post more than two listings per platform or book more than two visitor groups for the same date.

    Required
  • Santa Monica operating control 3

Keep total occupancy and visitor vehicles at or below the city-approved limits and display those limits in every advertisement.

    Required
  • Santa Monica operating control 4

Maintain smoke detectors, carbon-monoxide detectors, fire extinguishers, and required exit-route information for multi-story multifamily buildings.

    Required
  • Santa Monica operating control 5

Amend material application information within the city’s required window and renew the permit and business license for the July 1–June 30 license cycle.
