Decision rule

Anaheim STR status: the answer first

Anaheim does not accept ordinary new residential short-term rentals. The city’s current program says the opening of entirely new STRs remains prohibited; the permit system primarily serves eligible pre-moratorium rentals and certain previously authorized C-G commercial-zone properties.

This is a grandfathered-eligibility regime, not a general permit checklist. A buyer, new host, or owner of an unpermitted home should not assume that paying a fee or obtaining a business license can create STR eligibility.

Anaheim regulates dwelling units rented for short stays under Chapter 4.05, but current eligibility turns on pre-moratorium permit history or a qualifying pre-moratorium commercial conditional-use approval.

  • New residential STRs prohibited

Generally unavailable to new residential entrants; eligible legacy permits require renewal, business licensing, TOT, and operating compliance.

Address and property eligibility

Complete these checks before paying a non-refundable fee or accepting a reservation.

  • Eligibility gate 1

Confirm an existing Anaheim STR permit and the property’s pre-moratorium or specifically authorized status; a listing history alone is not enough.

    Required
  • Eligibility gate 2

Check whether a transfer, ownership change, relocation, CC&R limitation, or permit history affects continued eligibility.

    Required
  • Eligibility gate 3

Do not buy or furnish a property on the assumption that Anaheim will issue a new residential STR permit.

    Required

Required approvals and records

Keep each account or approval separate so one receipt is not mistaken for full authorization.

STR permit
Maintain and timely renew the eligible legacy permit.
Business license
Maintain a separate Anaheim business license for the property.
TOT account
Collect, separately state, report, and pay the 15% transient occupancy tax.
Application evidence
Provide ownership/agent/contact details, site and floor plans, parking, occupancy, acknowledgements, and any city-requested inspection access.

A workable Anaheim compliance sequence

The Anaheim permit task is a renewal and legacy-eligibility workflow. The first deliverable is proof that the property already belongs to an eligible permit class; there is no general new residential STR application path.

  1. Prove legacy eligibility

Retrieve the active permit, permit history, property record, and any pre-moratorium or C-G authorization.

  2. Check change consequences

Ask the city before ownership, agent, floor-plan, bedroom, or permit-location changes.

  3. Prepare the renewal file

Update owner/entity, agent, local contact, plans, parking, occupancy, and acknowledgements.

  4. Submit by the July deadline

File a complete renewal no later than the last business day of July with the current fee.

  5. Maintain business and TOT accounts

Keep the business license active and separately state and file Anaheim’s 15% TOT.

  6. Operate within permit conditions

Honor occupancy, parking, local-contact, noise, and property-specific permit conditions.

Lodging tax and marketplace handling

Treat registration, collection, filing, and marketplace reporting as separate checks.

Anaheim imposes a 15% transient occupancy tax on rent and requires it to be separately stated. The city publishes STR-specific return instructions and monthly due dates. A business license and TOT account do not make an otherwise ineligible property eligible for an STR permit.

  • Collection and filing are different duties

Record who collects each tax on each channel, who files the return, and what evidence supports exemptions or marketplace deductions.

    Warning

Operating rules and enforcement exposure

Advertising or operating without a valid permit is unlawful. Permit modification, suspension, revocation, and appeal procedures are in Chapter 4.05, and eligibility can be lost through untimely or incomplete renewal or unapproved changes.

  • Operating control 1

Operate only under an active permit for an eligible property and owner/transfer status.

    Required
  • Operating control 2

Maintain the separate Anaheim business license and 15% TOT reporting.

    Required
  • Operating control 3

Use the approved floor plan, occupancy, parking, and local-contact arrangement; changes can require city review.

    Required
  • Operating control 4

Do not use residential permit-parking privileges to expand guest parking for an STR.
